Refund Policy

This Refund Policy outlines the terms under which payments made to Forty V for digital product development and technology services are handled.
By engaging Forty V’s services, the client agrees to the terms stated in this policy.
1. Payment Structure
Forty V projects follow the below payment structure unless otherwise agreed in writing:

50% – Advance Payment (to initiate the project)

25% – Development Milestone Payment
-
25% – Final Payment prior to production deployment
All payments must be completed as per the agreed schedule for the project to proceed without delays.
2. Non-Refundable Payments
All payments made to Forty V are strictly non-refundable.
Once a payment is made toward the project, it is considered a commitment to allocate resources, development capacity, and project planning.
This includes but is not limited to:

Advance payments
-
Milestone payments
-
Final payments
-
Any additional services or upgrades
3. Project Cancellation by Client
If the client chooses to cancel the project at any stage after payment has been made, no refunds will be issued.
The client acknowledges that project resources, planning, and development time are allocated once the engagement begins.
4. Design Approval and Project Timeline
Before development begins, Forty V will provide a design prototype or product blueprint for approval.

Clients are allowed to request revisions before the design is finalized.

Once the design prototype is approved and locked, the 45-day development timeline officially begins.
After design approval:

Design changes may require additional scope adjustments.

No refunds will be applicable for design revisions or scope changes.
5. Delivery and Completion
A project is considered delivered when the product is:
Successfully deployed to the production environment as agreed in the project scope.
Production deployment includes:

Hosting deployment or server deployment
-
Functional access to the platform or application
-
Completion of agreed development scope
6. Project Delays
In cases where delivery timelines extend beyond the estimated schedule, Forty V may require additional time to complete the project.
However:

Such delays do not qualify the client for a refund.

Forty V will continue working towards completing the project deliverables.
7. Third-Party Costs and Integrations
Payments related to third-party services are non-refundable.
These may include but are not limited to:

Hosting services
-
Domain registration
-
API integrations
-
Payment gateway charges
-
App store developer accounts
-
External software tools or licenses
Such services are governed by their respective providers' policies.
8. Refund Processing
In the rare case where Forty V approves a refund at its sole discretion, refunds (if any) will be processed within 14 working days from the date of approval.
Refunds will be issued through the original payment method where possible.
9. Jurisdiction
This Refund Policy shall be governed by and interpreted in accordance with the laws of India.
Any disputes arising from services provided by Forty V shall fall under the exclusive jurisdiction of the courts in Coimbatore, Tamil Nadu, India.
